บทคัดย่อ
บทความนี้มีวัตถุประสงค์เพื่อทบทวนมาตรการควบคุมเครื่องดื่มแอลกอฮอล์ในประเทศไทยและต่างประเทศ และให้ข้อเสนอเชิงนโยบายในแต่ละมาตรการที่สำคัญ ดังนี้ มาตรการควบคุมโฆษณา ควรยกระดับมาตรการของหน่วยงานอื่นนอกเหนือจากพระราชบัญญัติควบคุมเครื่องแอลกอฮอล์ พ.ศ. 2551 เช่น กฎหมายคุ้มครองผู้บริโภค กฎหมายเยาวชนมาตรการควบคุมจุดจำหน่าย สนับสนุนการออกใบอนุญาตแบบ community licensing โดยการให้หน่วยงานปกครอง ส่วนท้องถิ่น พร้อมทั้งจัดเก็บค่าธรรมเนียมใบอนุญาตทั้งร้านไม่มีที่นั่งดื่ม และร้านนั่งดื่ม และกำหนดให้มีการเพิ่มโทษการขายโดยไม่มีใบอนุญาต มาตรการกำหนดประเภทของบุคคลที่เกี่ยวข้องกับการขาย สนับสนุนให้มีกฎหมายห้ามขายในสตรีมีครรภ์ และผู้ติดเครื่องดื่มแอลกอฮอล์ และเพิ่มประเด็นการห้ามใช้ จ้างวาน หรือยินยอมให้ผู้เยาว์เข้ามามีส่วนเกี่ยวข้องกับกระบวนการขาย และกำหนดให้ผู้จ้างวานต้องมีส่วนรับผิด มาตรการควบคุมฉลากและบรรจุภัณฑ์ควรพัฒนากฎหมายฉลากให้มีความชัดเจน โดยเฉพาะคำนิยามและรายละเอียด ให้ครอบคลุมกับลักษณะของผลิตภัณฑ์ในท้องตลาด มาตรการควบคุมการผลิต สนับสนุนการเพิ่มค่าธรรมเนียม และลดจำนวนปีที่อนุญาตในแต่ละครั้ง สำหรับการผลิตในครัวเรือน ควรมีเงื่อนไขที่ชัดเจน มีการตรวจสอบกระบวนการผลิต และไม่ปล่อยเสรี มาตรการสนับสนุนการจำหน่ายอย่างรับผิดชอบ ผู้ขายมีหน้าที่พึงระวังต่อความเสียหายต่อลูกค้าและผู้อื่นโดยสนับสนุนให้ผู้ขายรับผิดทางแพ่ง (commercial host liability หรือ dram shop liability) หากผู้ขายมีความประมาท มาตรการควบคุมวันและเวลาขายสนับสนุนมาตรการด้านวันและเวลาขายไว้คงเดิม และเพิ่มความเข้มแข็งในการบังคับใช้กฎหมายให้มีประสิทธิภาพมากยิ่งขึ้นและมาตรการควบคุมราคา ควรเพิ่มอัตราภาษีสรรพสามิตสุราขาวให้อยู่ในระดับเดียวกับเครื่องดื่มชนิดอื่น ควรขึ้นอัตราภาษีเครื่องดื่มที่นิยมของเยาวชน ควรขึ้นภาษีทุกปีตามอัตราเงินเฟ้อ และควรเริ่มศึกษาความเป็นไปได้ในการกำหนดราค ขั้นต่ำของเครื่องดื่ม (minimum unit pricing)
