Law on Protection of Riders

The objectives of this independent study were to study the current problems and legal concepts regarding the protection of the rights and welfare of delivery riders and for comparative study of such protections under Thai, international laws and foreign laws, and were study to analyze the issues in protecting the rights and welfare of delivery riders and were study to propose legal development guidelines for their protection. The researcher hypothesized that if Thailand had specific legal measures to protect the rights and welfare of delivery riders, it will ensure that delivery riders receive the fair protection of right and welfare that are consistent with the specific characteristics of this type of labor. By conducting a comparative of delivery riders protection with the law of Spain and United Kingdom.
The researcher conducted applied qualitative method to collect data and analyze from documents to find conclusions and provide recommendations to solve the issues of delivery riders protection.
The findings revealed that Labor Protection Act B.E. 2541 are not consistent with the working conditions of delivery riders because this act apply to general labor protections, it is inconsistent with the working methods of delivery riders. Moreover, there is no specific law to protect delivery riders properly. As a result, delivery riders do not receive protection adequately and appropriately. Therefore, this study recommends to enact the Delivery Riders Protections Act to be able to protect delivery riders, who are a new type of labor, to receive the protection of the right and welfare that are consistent with the characteristics of this type of labor.
